Dubai levies no income tax on private rental income. That is correct, and it is only half the answer. Whether you pay tax as an owner is decided not by where the property is, but by where you are tax resident.
Private property in Dubai carries no annual property tax, no income tax on rental income and no tax on the gain when you sell. These are the points in every brochure, and they are accurate (see also Taxes in Dubai). What is often missing: Dubai is not cost-free for that reason. A one-off DLD fee of 4 percent applies on purchase, and service charges recur. An overview is in the article on transaction costs.
Anyone resident or habitually staying in Germany is subject to unlimited tax liability there and must declare worldwide income. That includes rent from an apartment in Dubai. Whether and how that income is taxed in Germany depends, among other things, on whether a double tax treaty applies. According to the law firm JUHN, the German-Emirati treaty expired on 31 December 2021, and no new one has been signed so far. Buyers from Switzerland or Austria are covered by other treaties with their own rules. Always confirm the current position with your tax adviser before you calculate.
This has a practical consequence for the return calculation. A net yield that looks tax-free in Dubai can come out very differently after tax for a buyer resident in Germany. Never calculate with the Dubai figure alone.
Tax-free rental income is realistic only if your centre of life genuinely moves to Dubai. That means giving up every residence in Germany, not just re-registering the main one. A Golden Visa alone does not establish tax residence in the UAE. Anyone who takes this step only because of a property is buying a decision that reaches far beyond the unit. The reverse also holds: if you stay in Germany, do not plan Dubai as a tax-free zone.
Since 2023, the UAE has levied a corporate tax on business profits. For the private purchase of an apartment, our understanding is that this is usually not the lever. It becomes relevant if a buyer holds through a company or runs the letting as a business. In those cases, the structure deserves a proper review before purchase, by someone who knows both legal systems.
TAH perspective
We are not tax advisers and do not present ourselves as such. We name the questions that should be settled before purchase and work together with your tax adviser. The mistake we see most often is not a wrong answer, but a question that is never asked.
First: where are you tax resident today, and will that stay the case? Second: how are rental income and a later sale treated in your country, with and without a treaty? Third: do you buy privately or through a structure, and what does that mean on both sides? Fourth: what is the succession plan if you later want to pass the property on? On the latter, see also the entry on the DIFC will. Once these four questions are answered, the calculation holds. Before that, it is an assumption.
If you would like to place your own situation, the first step is a conversation in which we capture your goals, residence and structure before any property comes up.
In Dubai itself, no income tax applies to private rental income. Whether you pay tax in your country of residence depends on where you are tax resident. Anyone resident in Germany must in principle declare worldwide income there.
According to the law firm JUHN, the previous treaty expired on 31 December 2021, and no new one has been signed so far. Confirm the current position with your tax adviser before buying.
No. Private property in Dubai carries neither an annual property tax nor a tax on the sale gain. A DLD fee of 4 percent applies on purchase, and service charges recur.
No. A Golden Visa alone does not establish tax residence. What matters is where your centre of life actually is and whether you give up your residences in Germany.
